The petitioner has approached this Court being aggrieved of the decision taken by the respondents to not grant him parole leave.

Learned Public Prosecutor and Senior Counsel submits that the police report is received and respondents are all set to release the petitioner on parole leave. The report is tendered across the bar. Same is taken on record. Statement is accepted. 3.

Learned counsel for the petitioner submits that marriage of petitioner's sister is scheduled tomorrow at 7.00 p.m. The respondents shall, therefore, take decision today itself.

So far as challenge to Rule 21(9) of the Maharashtra Prisons (Bombay Furlough and Parole) Rules, 1959, as amended on 2-12-2024, is concerned,
