In the present petition, the following prayers are made : "a. Direct the Respondent no.2 to appoint the Petitioner on compassionate grounds in view of the Government Resolution dated 21.09.2017 and 17.07.2025 in place of his deceased father with the Respondent no.2, and;

b.

In alternative to prayer clause "a" direct the Respondent no.2 to decide the representations of the Petitioner which are pending since 2017 to appoint the Petitioner on compassionate basis, as expeditiously as possible, and;

c.

Allow the petition, and;

d.

Any other relief to which the petitioner is entitled to in the facts and circumstances of the case."

Since the petitioner is claiming appointment on compassionate grounds, we are of the opinion that if prayer 'b' is considered and allowed, the purpose will be served.

Accordingly, we dispose of the present petition with direction to the respondent No.2 to consider the petitioner's claim in accordance with law and the Scheme, for appointment on compassionate grounds. 4.

The learned counsel for the petitioner submits that the petitioner, instead of appointing on regular basis on compassionate grounds, is being

2 WP-7445-2025.odt appointed on daily wages and the consequences of filing of the petition may be the termination of the services as Daily Wager. 5.

Considering the above-referred submission of the learned counsel for the petitioner, liberty is granted to the petitioner to file a substantive petition, if such occasion arises.
