APRIL 27, 2018 Heard Ms. Sheetal Deshpande, learned counsel for the applicant and Shri Pathan, learned APP for the State. Perused the reply of the prosecution and the case diary. The allegations made against this applicant for the present only reveal that there were some transactions between the complainant and this applicant in the nature of giving of cash amount by this applicant to the complainant with a promise that same would be returned along with some higher returns. But, there is no material present on record showing that the element of criminal dishonesty as contemplated in criminal law has been involved and therefore, I am of the view that this case is a fit case for grant of anticipatory bail.

In the result, I am inclined to grant this application. The application is, therefore, allowed.

Ad-interim anticipatory bail granted by this Court to this applicant on

ABA932.17 26.12.2017 is hereby confirmed on the same conditions with clarification that the applicant need not attend the police station except when he is called upon to do so by the Investigating Officer.

The application stands disposed of.
