The applicant - appellant is challenging the judgment of acquittal in Summary Criminal Case 135 of 2016 whereby the learned Magistrate acquitted respondent - accused of offence punishable under section 138 of the Negotiable Instruments Act, 1881.

It would be necessary to revisit the material on record since the issue is whether the learned Magistrate appreciated the import and implication of sections 118 and 139 of the Act correctly.
