From the reply filed by respondent no.1, it is noticed that respondent no.1 has realized his mistake in raising point of validity of sanction while seeking discharge from the case and that is the reason why the respondent no.1 has tendered an conditional apology to this Court, as stated in paragraph nos.9 an 11 of the reply. It is informed by the learned counsel for the respondent no.1 that even the discharge application has been rejected by the trial Court and the revision application filed before the District and Sessions Judge, Amravati does not raise any question of validity of the sanction.

As the mistake has been realized and it has

2702cp6.18 2/2 not been repeated when the revision application was filed before the Sessions Court, Amravati, as is seen from the averements made in paragraph no.14 of the reply, I am of the view that the apology tendered unconditionally deserves to be accepted. Accordingly, the apology is accepted and the matter is closed and same is disposed of accordingly.
