(Passed on 11.02.2023) The appellant - National Insurance Company is present through it's Counsel Shri C. A. Anthony and the respondent No.1 is present through her Counsel Ms. Uma Bhattad. The respondent No.2 is absent. He is formal party. The appellant has filed pursis stating therein that the appellant is withdrawing this appeal as it does not want to proceed with this appeal. The Counsel for the appellant stated that the appellant has already deposited the entire decreetal amount together with interest. As the appellant wants to obey the decree passed by the Trial Court, this appeal is hereby disposed of, as withdrawn. The respondent No.1 is hereby given liberty to withdraw the amount deposited by the appellant, alongwith interest accrued thereon. The requisite court fees, if any, be refunded to the appellant, as per rules.
