Learned A.P.P. has pointed out paragraph no. 5 of the reply filed on behalf of non-applicant no. 1/State. The reply is not available in either of the sets of the Court, however, learned A.P.P. has supplied office copy of the reply at the time of hearing. In paragraph 5 of the reply, it is stated that the non-applicant no. 1 - Investigation Agency would be filing C-Final Report before the learned Magistrate.

Accepting the above submission, in our view, the prayer of the applicant that the First Information Report

APL 1132.2018.odt registered against him be quashed, would not survive. Hence, we see no reason to keep this application pending. After filing of C-Final Report before the learned Magistrate, as stated by non-applicant no. 1/State, the parties will be at liberty to take appropriate steps as per law.

In view of the above, the criminal application is disposed. No costs.
