Heard Shri Thakkar for the applicant.
2] He has pointed out report lodged by complainant against the applicant and the report lodged by one Rahul Vishnu Desai against the complainant namely Tabrej. As per the report lodged by Rahul Vishnu Desai offence punishable under section 307 read with section 34 of IPC is registered against Tabrej. On the report of Tabrej the offence punishable under section 307 of IPC is registered against the present applicant. The applicant is in jail from 07.11.2018. Shri Dubey, the learned Additional Public Prosecutor has strongly objected the application. Looking to the report and counter report lodged by Rahul Vishnu Desai against complainant Tabrej. It appears that there was quarrel between two groups and both group lodged complaint against each other. Most of the part of investigation appears to be completed.
ba1121.18.O.odt Therefore, further detention is not required. Hence, the following order.
[i] The application is allowed.
[ii] The applicant be released on bail on furnishing PR bond in the sum of Rs.25,000/- with one solvent surety in the like amount on following conditions.
[a] The applicant shall not tamper the evidence of prosecution witnesses.
[b] The applicant shall attend the trial Court on each and every date.
[c] Breach of any condition amounts to cancellation of bail.
