Heard Shri S.I. Ali, learned counsel for the applicant and Shri B.M. Lonare, learned APP for nonapplicant No. 1. By this application, offences registered vide Crime No. 211 of 2017, which are punishable under Section 353, 332, 504 read with Section 34 of the Indian Penal Code, have been sought to be quashed and set aside. In the First Information Report dated 16.06.2017 lodged by one Nageshwar Manohar Kulmethe, who is working as a Technician with MSEB, Murtizapur, District - Akola, name of this applicant has not been taken and that one person named as accused therein has been described as "Shaikh Guddu". There is one more statement of the complainant recorded on 17.06.2017 and in this statement, the accused described as "Shaikh Guddu" finds no mention and in his place, name of the applicant has been mentioned. During the course of the investigation, statements of the eye witnesses came to be recorded and on going through them, we find that these eye witnesses have specifically taken name of this applicant as the person who

2404apl1135.18 has indulged in beating and abusing the complainant. With such facts present on record, we are not inclined to entertain this application. Criminal Application stands summarily dismissed.
