This is an application seeking condonation of delay of 2570 days in preferring an appeal against the judgment and order dated 22.08.2011, passed by the Civil Judge Senior Division, Pusad, in LAC No.515 of 2002.

Shri Patre, learned counsel appearing for the Applicant/ Appellant draws the attention of this Court to paragraphs 3 to 8 of the application in support of his contention to condone the delay. Learned counsel submits that in appeals filed by the real brothers of the present Applicant i.e. First Appeal (St.) No.27358 of 2018 and First Appeal (St.) No.28089 of 2018, this Court has condoned the delays and directed registration of the said appeals. He tenders across the bar orders dated 28.04.2022 and 02.03.2022 in both the appeals. 3.

Learned Assistant Government Pleader waives service of notice for Respondents No.1 and 3, Shri Kadu, learned counsel submits that he waives service of notice on behalf of Respondent No.2. The learned counsel for the Respondents

18 CAF-3030-2019 have no particular objection, if the delay is condoned. 4.

Having heard learned counsel and having perused the application and the orders tendered across the bar, let the delay of 2570 days be condoned. Let the appeal be registered within a period of two weeks from today.

The civil application stands disposed.

Shri Patre, learned counsel appearing for the Appellant submits that the two appeals referred to in the order tendered across the bar have already been decided in favour of the Appellants and as such if this matter could be listed for final disposal that would be in the interest of justice. 7.
