Heard Advocate Shri Tiwari for the applicant and Shri Dhumale, learned APP for the non-applicant/State. Learned Advocate for the applicant has submitted that anticipatory bail application of the applicant wrongly rejected by the Sessions Judge on the ground that in view of Juvenile Justice Act, he is not entitled for protection under section 438 of Cr.P.C. Learned counsel has pointed out the judgment of this Court in the case of Yogesh Jagdish Joshi (Minor) v. State of Maharashtra reported in II (2002) CCR. The said judgment is considered by this Court while granting ad-interim anticipatory bail on 10.12.2018. Hence, ad-interim anticipatory bail granted by this Court on 10.12.2018 is hereby confirmed.
