Heard the learned counsel for the petitioners. 2.

In short, it is the submission of the petitioners that though the proceedings under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 under Section 14 are decided, no steps are taken to recover the possession. 3.

He further submits that he was put in possession but thereafter, unfortunately the private respondent has again trespassed the premises. According to him, the issue is squarely covered by the order of the Principal Seat of this Court, passed in Writ Petition No.289 of 2024 (State Bank of India Vs. State of Maharashtra & Ors.) dated 17.01.2024.

Be that as it may, in peculiar facts and circumstances of this case, we direct the respondent No.5-Tahsildar, Bhandara to decide the issue regarding grant of possession in light of the above mentioned judgment in accordance with law within eight weeks from receipt of this order. 5.

The learned counsel for the petitioners undertakes to furnish a copy of this order before the concerned authority within a period of two weeks from today.

Accordingly, the petition is disposed of.
