Heard Shri N.R. Tekade, learned counsel for the applicants, Shri A.M. Balpande, learned APP for respondent No. 1 and Mrs. V. Khadekar, learned counsel for respondent No. 2.

Before hearing of this application begun, it is brought to the notice of this Court by the learned counsel for respondent No. 2 that both these applicants, during interregnum, had filed applications before the trial Court seeking their discharge from the case and those applications are pending consideration and disposal, according to law by the concerned Court of the Magistrate.

The learned counsel for the applicants, on instructions, submits that the applications are indeed filed by both these applicants, seeking their discharge and they are pending. He, on instructions, seeks leave of this Court to withdraw the present application, keeping all contentions open and also with a prayer for issuing directions to the trial Court for early disposal of their discharge applications.

0402apl1143.18 The learned APP for respondent No. 1 as well as the learned counsel for respondent No. 2 have no objection. In the circumstances, leave to withdraw the application with prayer made is granted. Criminal Application is disposed of as withdrawn. All contentions of the parties are kept open. The trial Court is directed to decide the discharge applications filed by both these applicants at the earliest and preferably within eight weeks from the date of the order.

A copy of this order be communicated to the learned Magistrate of the trial Court for taking necessary steps in the matter.
