The applicants have apprehension of arrest in Crime No.0291/2025 registered with Police Station Patur, District Akola for the offences punishable under Sections 109, 115, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on 20.09.2025, the informant has stated that on 14.09.2025 at about 6.00 p.m. a quarrel took place amongst the first informant, her mother-in-law and husband. The husband beat her, therefore, she called her mother-in-law. Motherin-law also beat her and called the applicants, who are nephew of mother-in-law. The allegations are about mercilessly beaten by the husband and mother-in-law. Thereafter, these applicants put rat poison in her mouth and tried to kill her. They helped the husband to hold her and applicant No.2 put the poison in her mouth. Hence, the crime is registered.

The learned Counsel for the applicant has stated that though the incident took place on 14.09.2025, the complainant has lodged the complaint on 20.09.2025.

2 18.aba.925.25 Her statement was recorded on 20.09.2025. Her husband and mother-in-law are arrested and released on bail. The injured is also discharged from hospital. The applicants went there to pacify the quarrel. No statement of independent witness is recorded. Hence, prayed to protect the applicants by granting anticipatory bail. 5.

Learned A.P.P. opposed the application stating that, C.A. report is yet to receive. Medical report shows that it was case of poisoning. The allegations are about mercilessly beaten by the husband and mother-in-law and these two applicants tried to put the poison in the mouth of the complainant. Considering the allegations made against these applicants, prayed to reject the application. 6.

Heard the learned Counsel for the applicants and the learned A.P.P. for the State.

The allegations against these applicants are that they put rat poison in the mouth of the complainant. The presence of these applicants is not denied. The applicants have stated that they went there to pacify the quarrel and their names are mentioned. There is no witness. Her husband and mother-in-law against whom the serious allegations are made, are arrested and already released on bail.

Considering the circumstances, custodial interrogation of these applicants is not necessary. Accordingly, I pass the following order:

i] It is directed that in the event of arrest of the applicants namely applicant No.1 - Shubham Deepak Jadhav and applicant No.2-

3 18.aba.925.25 Rahul Deepak Jadhav, in connection with Crime No.0291/2025 registered with Police Station, Patur, District Akola for the offences punishable under Sections 109, 115, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, shall be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- each with one solvent surety each in the like amount.

ii] The applicants shall not in any way tamper with the prosecution evidence.

iii] The applicants shall not pressurize or threaten the prosecution witnesses.

iv] The applicants shall attend the concerned police station on every Monday and Saturday between 1:00 p.m. to 2:00 p.m.

v] The applicants shall co-operate the Investigating Officer.

The application stands disposed of accordingly.
