The applicant is arrested in Crime No.491/2019 for the offences punishable under Sections 302, 307, 341, 323, 143, 147, 148, 149 of the Indian Penal Code and Section 135 of the Maharashtra Police Act.

The applicant was released on bail on 27.07.2020 by this Court. Thereafter, he remained absent before the Trial Court, and NBW was issued against him, and he was taken into custody. Again on 17.12.2024, this Court has granted bail with the direction that, if he remains absent on a single day, then his bail will be cancelled. The applicant again remained absent from 10.01.2025 to 18.03.2025 for a consecutive five dates. Thereafter, again NBW was issued against him and he was taken into custody. Since 18.03.2025, the applicant is in custody. 4.

The applicant has filed this application on the ground that his mother is suffering from cancer. There is nobody to take care of her. She is in Government Cancer Hospital. She is on deathbed. He will attend the trial if he is released on bail. It is necessary for him to release on bail as there is nobody to take care of his mother.

The applicant has filed on record the documents showing that his mother is suffering from cancer. 6.

Considering the reason for remaining absent before the Trial Court, the application is allowed with the condition to attend the trial regularly though the mother is suffering from cancer and she is on deathbed. Accordingly, I proceed to pass the following order :

i] The criminal application is allowed.

ii] The applicant shall be released on bail in connection with Crime No.491/2019 for the offences punishable under Sections 302, 307, 341, 323, 143, 147, 148, 149 of the Indian Penal Code and Section 135 of the Maharashtra Police Act, on furnishing P.R. Bond of Rs.25,000/- with one solvent surety in the like amount.

iii] The applicant shall attend the trial regularly though the mother is suffering from cancer.

The Criminal application is disposed of accordingly.
