The original defendant has challenged the order passed by the trial Court by which the application (Exh.103) filed by him for re-casting the issues is dismissed. The learned trial Judge has observed that the issue Nos. 1, 2 and 6 already framed cover the proposed draft issue and therefore, there is no need to recast the issues.
I have examined the issues framed by the trial Court on 17th February 2014. The observations of the learned trial Judge that, issue Nos.1, 2 and 6 cover the proposed draft issue, are proper. It cannot be said that the impugned order suffers from any error of jurisdiction.
The writ petition is dismissed. No costs.
