Learned A.P.P. waives service of notice for nonapplicant/State. CRIMINAL APPLICATION (APPR) NO. 260/2025 4.

This is an application for suspension of sentence.

The applicant is challenging the impugned judgment dated 21.11.2025 passed by the Sessions Judge, Gadchiroli in Criminal Appeal No.16/2023 thereby convicting the applicant for the offence punishable under Section 65(e) of the Maharashtra Prohibition Act and sentencing him to suffer simple imprisonment for six months and to pay fine of Rs.25,000/-.

The applicant had already deposited the entire fine amount of Rs.25,000/-. Hence, he prayed to suspend the sentence during the pendency of revision application and release the applicant on bail.

As the applicant has filed the revision application before this Court, the application is allowed. Accordingly, I pass the following order :

i] The judgment and order dated 21.11.2025 passed by the Sessions Judge, Gadchiroli in Criminal Appeal No.16/2023 shall remain suspended during pendency of the present revision.

ii] The applicant - Mahesh s/o. Baburao Shette be released on bail on he executing P. R. bond of Rs.25,000/- with one solvent surety in the like amount.

iii] The applicant is directed to attend the concerned Police Station once in six months and shall mark his presence during the pendecy of the present revision.

iv] The applicant is directed to remain personally present before this Court at the time of final hearing of this revision.

With these observation, the application is allowed and disposed of.
