Vide order dated 13-10-2021, this Court recorded the statement of the learned counsel for the petitioner that within two weeks, the maintenance amount shall be deposited in the Court. The backdrop is that while granting interim relief, the petitioner was directed, as undertaken by him, to pay Rs. 5,000/- (Rupees Five Thousand) per month towards maintenance of the minor son who is with the respondent - wife.

The order dated 17-12-2021 reads thus :
"Learned Advocate for the petitioner submits that he could not contact his client since he did not pick up his phone.
Learned counsel for the petitioner is granted another opportunity to contact the petitioner, as a last chance.
Stand over two weeks."

It is apparent that the petitioner is deliberately flouting the directions to pay maintenance to the son.

Since there is no representation today, the petition is dismissed for want of prosecution with costs of Rs. 10,000/- (Rupees Ten Thousand).

If any application for restoration is made, the Registry shall ensure that the direction to pay costs is duly complied with. The costs if paid, shall be deposited with the High Court Legal Services Sub-Committee, Nagpur.
