By this application, the applicant is seeking the condonation of 1031 days caused in filing the application for restoration of appeal which was dismissed for not filing the private paper book. For the condonation of delay, the applicant has given the specific reasons in para 4 and 5 of the application. 2.

Hence, considering the said reasons which are not controverted in the matter, the delay of 1031 days is hereby condoned.

According to the appellant, the present appeal is covered by the judgment delivered by this court in First Appeal No.1053/2019. Therefore, filing of paper book would not be necessary in the matter. According to him, if this appeal is restored, the same can be decided finally in view of the judgment of this court which covered the subject matter involved in the first appeal.

Hence, for the reasons stated in the application, the appeal is restored to its original position. The order of dismissing the appeal is hereby recalled.
