This appeal challenges the order dated 23.11.2018 rendered by Additional Sessions Judge, Buldana whereby the application preferred by the appellant under section 438 of the Code of Criminal Procedure is rejected. The appellant is facing prosecution under section 324, 325 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 (Atrocities Act). By order dated 28.12.2018, this Court directed that the appellant be released on interim bail.

Today, a statement is made by the learned Additional Public Prosecutor Shri Amit Chutke that the chargesheet is filed.

In this view of the matter, it would be appropriate if the appellant appears before the trial Court and seeks regular bail in view of the change in circumstance i.e. filing of the chargesheet.
