Heard Shri A.A.Dhawas, learned counsel for the applicant.

From the order rejecting the bail application, it is clear that the applicant is prosecuted for the offence punishable under Sections 279 and 304-A of the Indian Penal Code. Both the offences are bailable. The applicant could not remain present on the date fixed by the trial Court. Therefore, non-bailable warrant was issued. He himself appeared before the Court and filed application for cancellation of non-bailable warrant, but the same was rejected on 01.12.2018. The Additional Sessions Judge, Warora, also rejected his application on 11.12.2018. It is not the case that, if the applicant is released on bail he creates hurdle for the trial Court. Hence, to put an end the speculations, it is must to put some stringent conditions. Hence the following order:-

2 917ba1164.doc I] The applicant be released on bail on executing P.R. bond in the sum of Rs. 15,000/- with one solvent surety in the like amount.

II] The applicant shall attend before the Trial Court on each and every date without fail.

III] The applicant shall not remain absent on any single date.

IV] Breach of any condition amounts to cancellation of bail.
