DATED : 17-10-2022 The application seeks quashing of the First Information Report and Crime 151/2018 registered under Sections 420, 467, 504 and 506 read with Section 34 of the Indian Penal Code.

We have noted that none appeared on behalf of the applicant on 07-10-2022.

We have further noted that the learned Counsel for the applicant has filed an application seeking discharge. The application dated 12-9-2022 states that the applicant did not attend the mediation and thereafter abruptly stopped giving instructions to the counsel. It is further stated that the applicant stopped receiving telephonic calls and therefore the counsel issued notice dated 25-3-2022 seeking instructions. It appears that the notice is duly received in April, 2022.

In this view of the matter, we discharge the learned Counsel Mr. Mir Nagman Ali.

We further dismiss the application for want of prosecution subject to costs of Rs.3,000/- to be deposited with the High Court Legal Services Sub-Committee, Nagpur.

The registry shall ensure that if application for restoration is filed, the direction to pay costs shall be complied with.
