In the morning session we heard Shri A. S. Mardikar, learned Senior Advocate in extenso. After hearing the learned Senior Advocate for the applicant and the learned Additional Public Prosecutor, when the Court has expressed its opinion that the Court is not inclined to interfere, the learned Senior Advocate requested that the matter be taken at 2.30 p.m. in order to take the instructions from the applicant. Accordingly, the matter is kept at 2.30 p.m.. At 2.30 p.m. when the matter is called out, Shri D. I. Jain, junior colleague of Shri Mardikar, learned Senior Advocate submitted that he is making a statement on behalf of the learned Senior Advocate that the applicant wishes to withdraw the present application. He submits that liberty be granted to the applicant to file the application for discharge before the Trial Court. 2.

His prayer is accepted.

The application is dismissed, as withdrawn with liberty as prayed for.

It is made clear that, since the learned Advocate for the applicant is withdrawing this application, the Court is not giving detailed reasons as to why the application needs dismissal.
