The original defendant has challenged the order passed by the trial Judge by which the application (Exh. No.70) filed by it under Order I Rules 10 and 11 of the Code of Civil Procedure is dismissed. By the application (Exh. No.70) the defendant prayed that M/s. Shree Shyam Sales, Nagpur is a necessary party and the plaintiff be directed to implead it as defendant. Learned trial Judge has rightly rejected the application recording that the defendant has no right to compel the plaintiff to implead any party. The learned trial Judge has not committed any illegality or error of jurisdiction which necessitates interference by this Court. The writ petition is dismissed. No costs.
