The petitioners-management in this writ petition has challenged the judgment of the School Tribunal dated 26.10.2018 wherein the appeal filed by the respondent no.1 has been allowed and after setting aside the order of termination dated 10.03.2016, his services have been directed to be reinstated in the petitioner no.2-College.

Today, it is informed that the petitioners and the respondent no.1 have arrived at a settlement wherein the respondent no.1 has given up his claim for back wages against the management. It is agreed between said parties that after reinstatement of the services of the respondent no.1, the management will forward the proposal for absorption of the respondent no.1 as well as for release of back wages and his regular salary.

In that view of the matter, the writ petition is disposed of by passing the following order:-

WP2008-19 I.

The joint pursis between the petitioners and the respondent no.1 is taken on record and marked Exhibit 'A' for identification. The same would bind the petitioners and the respondent no.1.

II.

After the proposal for absorption of the respondent no.1 as well as release of back wages and his regular salary is submitted by the management, the respondent no.2-Deputy Director shall consider the said proposal on its own merits in accordance with law.

III.

The said proposal be adjudicated upon within a period of six weeks from the date it is received by the respondent no.2. JUDGE APTE
