Heard Shri Mir Nagman Ali for the applicant and Shri N.R. Rode, learned APP for the non-applicant/State. Complainant was having love affair with one Nagesh. Applicant is brother-in-law of Nagesh. Nagesh had sexual intercourse with complainant. Applicant only asked her if she wanted to perform marriage with Nagesh, he will help her and for that purpose, she has to keep sexual relation with him. Except this allegation, there is no material allegation against present applicant. The main allegation in respect of sexual intercourse is against Nagesh and not against the applicant. Hence, the ad-interim anticipatory bail granted on 22.12.2018 is hereby confirmed.
