According to him, in pursuance to the tender notice, he participated and deposited the Earnest Money Deposit (EMD), but before opening the tender, the bid was cancelled. Re-tendering is also ordered.

Just because the petitioner has participated and deposited the EMD, we do not think that any right is crystallized in favour of the petitioner.
