Heard the learned Senior Advocate for the petitioner. 2.

A prayer in this petition is regarding declaration that the petitioner is exempted from securing qualification of National Eligibility Test (NET)/State Eligibility Text (SET). Other consequential prayers are also made. 3.

The learned Senior Advocate for the petitioner submits that the date of appointment of the petitioner is 07.09.1992. Whereas, the respondent-authority has adopted the UGC Regulation on 23.10.1992. He therefore, submits that there is absolutely no requirement of having the said qualification.

He further relied upon the judgment passed by this Court in the case of Asha .. vs. .. State of Mah. reported in [2013 (6) Mh. L.J. 657] as well as the Government nd.thawre

We have gone through the record. Since the issue is still not decided by the respondent No.3-Joint Director, Higher Education, Nagpur, we direct the respondent No.3 to treat the present petition as a representation and decide the issue raised in this petition in light of the judgment and the GR cited (supra), in accordance with law, within six weeks from the receipt of this order.

The learned counsel for the petitioner undertakes to furnish a copy of the present petition along with a copy of this order before the concerned authority within a period of one weeks from today.

The decision taken be communicated to the petitioner by the respondent-authority within one week thereafter.

Needless to mention that the points raised in the petition, including applicability of the GR cited (supra), be dealt with by giving specific reasons.

Accordingly, the petition is disposed of.
