Heard Shri Gaidhane, Advocate for the applicant. He has submitted that applicant is a labour. Supplementary charge-sheet was filed against the present applicant. He was shown as absconding in the original charge-sheet. The other co-accused are acquitted by the trial Court vide judgment dated 21.06.2012 in Session Trial No.153/2010. The application of the applicant came to be rejected on the ground that there is every possibility of absconding.
Shri Lonare, learned APP has strongly objected the application.
Police machinery required to file a supplementary charge-sheet after the arrest of present applicant. Crime No.115/2010 registered on 16.04.2010 since then applicant was absconding. Charge-sheet filed against other accused. Applicant was arrested and
ba1184.18.O.odt charge-sheet was filed on 04.07.2012. The applicant lastly attended on 3.09.2012. Since then absconding therefore, trial was separated and evidence against other accused came to be recorded and co-accused are acquitted by the trial Court. After the decision of the case present applicant came to be arrested and separate charge-sheet is filed. There is every possibility of absconding the accused. Hence, he is not entitled for bail. The application is rejected. However, the trial Court is directed to expedite the trial against the present applicant/accused and decide the same within a period of three months.
