Learned Counsel for respondent submits that Special Civil Suit No.25 of 2006 pending before the Civil Judge Senior Division at Khamgaon has been disposed of.

In that view of the matter, the petition has become infructuous. The petition is therefore dismissed as infructuous. 3.

Needless to state that in the event, the order dated 23.11.2018 passed below Exhibit - 1 which has been challenged in this petition in any manner affects the rights of any of the parties and the decree passed in the civil suit, such party shall have the right to raise a challenge to the impugned order by way of taking a ground in any appeal that may be filed against the decree.
