DATE : March 15, 2019 The petitioner challenges the order passed by the trial Court directing payment of interim monthly maintenance.

Shri S. U. Bhuyar, learned counsel for the petitioner submits that the petitioner was not heard when the aforesaid order was passed.

Perusal of the application filed by the respondents as well as the impugned order indicates that the petitioner had filed a reply to the application for grant of interim maintenance. The trial Court took into consideration the fact that the petitioner did not file any document indicating his monthly salary. It was also not disputed that the petitioner was working as a Teacher. On that premise the trial Court directed payment of monthly maintenance of Rs.3,000/- per month to the respondent No.1. It is found that there is no illegality committed by the trial Court while passing the impugned order.

920-WP-1896-19 2/2 By observing that the trial Court shall decide the main proceedings on their own merits without being influenced by any observations in the impugned order, writ petition stands dismissed with no order as to costs. JUDGE Asmita
