By order dated 2nd March 2017, learned Principal District Judge rejected the application filed by the petitioner under Section 24 of the Code of Civil Procedure, 1908. By the present petition filed under Article 227 of the Constitution of India, the petitioner has prayed that the proceedings of Regular Civil Suit No.47/2016 be transferred from the Court at Murtijapur to the Court at Akola. The petitioner has not challenged the order passed by the learned Principal District Judge by which the same prayer is rejected. In the absence of the challenge to the order passed by the learned Principal District Judge, the petition cannot be entertained under Article 227 of the Constitution of India. Hence the writ petition is dismissed with liberty to the petitioner to file fresh petition or appropriate proceedings according to law, if so advised.
