The learned counsel for the appellant states that respondent 2 is serving with the Indian Army and was last posted at Kamptee. It is stated that respondent 2 is transferred from Kamptee and despite the best efforts of the appellant, who is rustic person, the appellant is unable to ascertain the present address of respondent 2. 2] In this view of the matter, the Commanding Officer of Guards Regimental Centre, Kamptee is requested to provide current address of respondent 2.

3] The learned Additional Public Prosecutor shall act on the authenticated copy of this order.

4] The learned ASGI Shri Ulhas Aurangabadkar is also requested to extend his cooperation in the matter.

6] In view of the decision of the Supreme Court in Mallikarjun Kodagali (dead) represented through Legal Representatives v. State of Karnataka & Ors. reported in 2018(14) Scale 32, it would not be necessary for the appellant - who is father of the deceased - to seek leave. 7] This application is disposed of.

8] The appeal be registered.

9] Issue notice to the respondents, returnable on 01.07.2019.
