2026:BHC-NAG:87-DB 132-WP-91-2026.odt 1
IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
NAGPUR BENCH : NAGPUR.
WRIT PETITION NO. 91 of 2026 Sanjay s/o Shankar Chintamane vs.
The State of Maharashtra, through its Secretary, General Administration Department, Mumbai and others ------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order ------------------------------------------------------------------------------------------------------- Mr. Ram Karode, Advocate for petitioner.
Mr. A. V. Palshikar, Assistant Government Palshikar, for respondent nos. 1, 2 and 4. CORAM :- ANIL S. KILOR and RAJ D. WAKODE, JJ. DATE :- 6th JANUARY, 2026.
P. C.
Heard Mr. Ram Karode, the learned counsel for the petitioner.
2. The petitioner seeks to challenge the impugned order dated 13.11.2025 issued by the respondent no.4- Deputy Collector, and Rehabilitation Officer, Akola, whereby the claim of the petitioner to transfer the Project Affected Person Certificate in the name of the petitioner's son for grant of employment came to be rejected. 3.
The relevant dates for deciding the present petition are 30.03.1970 when the agriculture land of the petitioner was acquired for the development of Block No.II of the Central Campus of Punjabrao Krishi Vidyapeeth, Akola. On 30.06.1983 the Certificate of Project Affected Person was issued in the name of the petitioner. The contention of the petitioner is that at the relevant time the age of the petitioner was 18 years.
4.
Today, when the petitioner approaches this Court for seeking directions to transfer the said Project Affected Person Certificate dated 30.06.1983 in the name of his son for claiming the benefit of
132-WP-91-2026.odt 2 employment, the petitioner is 59 years old and superannuated. The aforesaid fact corroborates by the report which is submitted by the Associate Professor, Nagpur Veterinary College, Nagpur, stating therein that the appointment of the petitioner as 'Live Stock Supervisor' on 23.11.1993 was on the basis of the Project Affected Person Certificate. 5.
Thus, the claim of the petitioner that since he has not utilized the aforesaid Project Affected Certificate dated 30.06.1983, the same shall be transferred in the name of his son, and as such the impugned order dated 13.11.2025 is not sustainable in the eyes of law, loses its force. 6.
In that view of the matter, the present petition is dismissed. No order as to costs.
( RAJ D. WAKODE, J.) (ANIL S. KILOR, J.) Andurkar.
