On 8 June 2018, the following order was passed. "This is an application under Section 11 of the Arbitration and Conciliation Act, 1996. The dispute has arisen in respect of the Agreement for Sale dated 24 March 2001. Since the parties have failed to appoint an Arbitrator, this Application is made.

The learned Counsel for the parties state that Mr. M.S. Keny, retired Judge, having Office at B-7, Sapna Batista, St. Joaquem Road, Bodda, Margao, Goa be appointed as an arbitrator to arbitrate upon the disputes detailed in this Application.

3. Accordingly, it is decided to appoint Mr.

M.S. Keny, as an arbitrator to arbitrate upon the disputes referred to in the Application. The learned Counsel for the parties will serve a copy of the order upon the proposed Arbitrator.

4. To enable the Arbitrator to file his affidavit of disclosure as contemplated under the Act, S.O. to 29 June 2018"

2. The learned counsel for the parties placed on record an affidavit of Disclosure sworn by the arbitrator. They state that they have gone through the disclosure and have found it in order. Affidavit is taken on record.

In view of the order passed on 8 June 2018, Mr. M. S. Keny is appointed as an arbitrator.

The arbitrator to arbitrate upon the disputes referred to in the application. The learned counsel for the parties state that as regards the fees of the arbitrator they will decide the same before the leaned arbitrator. The application is accordingly
