We have heard Mr. Restogi, the learned Counsel for the petitioner and Ms. Desai, the learned Senior Standing Counsel for the respondents.

Mr. Restogi has taken us through the circular/instructions dated 17.08.2022 issued by the Department. Referring to the same, it is contended that the summons could not have been issued by the st February 2023
11-WP-58-2023.DOC respondents. The petitioner is cooperating in the investigations. The petitioner has submitted all the documents required. He also fairly submits that after the filing of the Writ Petition, the respondents have issued letters instead of summons to the petitioner to comply with certain requirements for furnishing the documents which the petitioner has also complied with.

It appears that after filing of the Writ Petition, the respondents have not resorted to the issuance of summons. The petitioner's apprehension probably was that issuance of repeated summons would entail further consequences. As further summons have not been issued and respondents have issued only letters and the purpose of issuance of summons also stands fructified, no further summons are required to be issued to the petitioner for the purpose for which the earlier summons were issued.

In the light of the above, the Writ Petition stands disposed of with no costs.
