2. The parties have tendered a joint pursis signed by the learned counsel for the parties, which is taken on record. Respondent no.1 has issued "No Due Certificate" in favour of the petitioner. Since the matter has been amicably settled between the parties, the order passed by J.M.F.C.in Criminal Case No.366/OA/NIA/2012/A is set aside and the petitioner is acquitted of the offence punishable under Section 138 of the Negotiable Instruments Act. He be released forthwith, if not required in any other case.
