1. Heard Mr Shirodkar for the Petitioner. Learned Advocate General appears along with Mr N. Vernekar, learned Addl. Govt. Advocate for Respondents No.1 to 5, 9 to 11.

2. For the orders that we propose to make, notice is not necessary to the Respondents.

3. The Petitioner, inter alia, complains that a show cause notice issued by the Village Panchayat of Chimbel on 21/8/2023 (Exhibit H to the Petition) is, till date, not disposed of by the Panchayat.

4. Accordingly, if the Panchayat has not yet disposed of the notice dated 21/8/2023, we direct the Panchayat to dispose of the same within two months from the receipt of an authenticated copy of this order. The Panchayat will have to comply with the principles of natural justice and fair play. The Panchayat will, accordingly, have to hear the noticee, as also the Petitioner (complainant) and dispose of this Notice dated 21/8/2023, if it is not disposed of.

5. The decision on the notice dated 21/8/2023 must be communicated to the Petitioner and the noticee within a period of two months from the date an authenticated copy of this order is placed before the Panchayat by the Petitioner.

6. Since we have not gone into the rival contentions, we clarify that all contentions of all parties are left open to be considered by the Panchayat in the first instance while disposing of the show cause notice dated 21/8/2023.

7. The Petition is disposed of in the above terms. There shall be no order for costs.

8. All concerned, including in particular the Village Panchayat of Chimbel, must act on an authenticated copy of this order. VALMIKI SA MENEZES, J.
