1. In view of the dismissal of the Petitioners Special Leave to Appeal No.4249/2022 by the Supreme Court vide its order dated 19.11.2024, the reliefs sought in this petition do not survive. Consequently, the petition is disposed of as being infructuous.
2. Considering that the order passed by the Controlling Authority, Regional Labour Commissioner Central, Vasco da Gama under the Payment of Gratuity Act dated 30.12.2021 has now become final, the Respondent would be entitled to the entire gratuity sum deposited before the Controlling Authority which is Rs.17,08,085/- less the 15th January, 2025
MCA 11 of 2025 amount of Rs.5,00,000/- allowed to be withdrawn by the Respondents vide dismissal order dated 08.02.2024. The Respondent No.2-Assistant Labour Commissioner Central is directed to make payment of the aforementioned amount directly into the account of the Respondent No.1. 3. Needless to state, the Respondent shall also be entitled to the entire interest accrued on the amount deposited that stands to his account. The amount shall be paid within a period of two weeks from the date of this order.
