Heard Mr. Om D'Costa, learned counsel for the Petitioner. Mr. D. Pangam, learned Advocate General appears along with Ms. Maria Correia, learned Additional Government Advocate for Respondent Nos. 1 and 2.

The learned Advocate General points out that the relief in terms of prayer clause 45(i) is already worked out now that the State Government has prescribed the payments to be made. Mr. Om D'Costa confirms this position.

Mr. Om D'Costa, learned counsel for the Petitioner based on the instructions from the Petitioner states that the Petitioner would be satisfied if this petition itself is considered as a representation to the State Government in regard to prayer clauses 45(ii) to 45(v) and the same is disposed of in a time bound manner.

The learned Advocate General states that the Secretary (Mines) will consider this petition as the Petitioner's representation and dispose of the same in accord with law as expeditiously as possible and in any case within three months from today. The learned Advocate General states that the decision on this issue will be communicated to the Petitioner within three months.

Thus, based on the above, we dispose of the petition. The Secretary (Mines) to act consistent with the statement now made by the learned Advocate General and dispose of the Petitioner's representation within three months from today. 6.

The Civil Application No.33 of 2021 does not survive and the same is also disposed of accordingly.
