1. The Misc. Civil Application No.59 of 2025 is filed by invoking Order 5 Rule 20 of CPC to serve respondent Nos.1(a), 1(b) and 2 by substituted mode of service.

2. Heard learned counsel for the applicant and perused the application which categorically states that notice issued to respondents mentioned above returned unserved and even in the trial Court and the First Appellate Court, respondent Nos.3 and 4 have been served. A request is therefore made that service may be effected by publication of notice in the local newspaper.

3. Considering that the application has substance and deserves to be allowed, as respondent Nos.1(a), 1(b) and 2 are to be served, 18th March, 2025

MCA 59 of 2025 substituted service is permitted. The application is made absolute in terms of the prayer clause.

The publication in the newspaper in terms of the substituted service shall indicate the next date of appearance of respondent Nos.1(a), 1(b) and 2 is 21.04.2025.
