After this matter was argued for sometime and I was not inclined to entertain the above Appeal From Order, the learned Counsel appearing on behalf of the Appellant sought leave to withdraw the above Appeal. He, however, submitted that he would like to make another application for injunction inter alia restraining the Defendant from creating third party rights in relation to the property of the deceased.

In view of the aforesaid statement, the above Appeal From Order is dismissed as withdrawn. The Appellant is free to make another application seeking interim reliefs in terms of the statement recorded earlier.

It is however made clear that I have not opined on the merits of such application or whether the same would be maintainable and all issues in relation to the said application are expressly kept open. 4.

If such application is filed, the same shall be decided on its own merits and in accordance with law.
