The appellant filed pursis and prayed for disposal of the appeal as withdrawn. It is submitted that the total amount of Rs.11,08,752/- as per the direction was deposited before this Court on 26.12.2017 and the claimant has withdrawn the amount of Rs.7,00,000/- out of the said amount as per the order dated 16.04.2018. Remaining amount was reinvested in the Nationalized bank which is not claimed by the appellant. Now the appellant only claimed an amount of Rs.25,000/- which was deposited at the time of filing appeal. As such, the permission is granted to withdraw the appeal itself. It is made clear that the claimant is entitled for the balance amount along with interest accrued thereon. However, the appellant is only entitled for Rs.25,000/- which was deposited on 21.03.2017 along with interest accrued thereon. Accordingly, the appeal is disposed of as withdrawn in terms of the order as above.
