Heard the learned Counsel for the applicant and the learned Special Public Prosecutor for the respondent.

2. This is an application for suspension of sentence.

3. The applicant has been convicted for the offence punishable under Sections 409 and 420 of Indian Penal Code (IPC, for short) and under Section 13(1)(c) and (d) read with Section 13(2) of Prevention of Corruption Act (P.C. Act, for short). For the offence punishable under Sections 409 and 420 of IPC, on each count, the applicant is sentenced to suffer imprisonment for a period two years and to pay fine of Rs.50,000/- and in default, to

CRMA/1/2017 undergo Simple Imprisonment for three months. For the offence punishable under Section 13(1)(c) and (d) read with Section 13(2) of the P. C. Act, the applicant is sentenced to suffer imprisonment for a period of one year and to pay fine of Rs.50,000/- and in default, to undergo Simple Imprisonment for one month. The applicant has deposited the total amount of fine of Rs.1,50,000/- before the Special Court. The applicant was all along on bail during the trial. In such circumstances, the application is disposed of by following order :

ORDER

(i) The substantive sentence of imprisonment awarded to the applicant, is suspended during the pendency of the appeal, on condition of the applicant furnishing a P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.

(ii) Bail Bonds shall be furnished before the Special Court. C. V. BHADANG, J.
