The notice was issued in this application on 18 August 2016. The learned counsel for the Applicant states that the heirs of Respondent No.4 have been served. He states that some other Respondents have not yet been served but they have been served with a copy of the Second Appeal and they have not put their appearance in Second Appeal.

2. In view of the fact that the heirs of Respondent No.4 have been duly served and other Respondents are already served in Second Appeal and considering the cause made out, the delay in filing the application is condoned. The application is allowed.

MCA/211/2016 Amendment to be carried out within a period of one week from today.
