Heard Mr Amonkar for the Petitioner. Mr Vallabh Pangam appears for Respondent No.1 and Mr Redkar appears for Respondent No.2.

After this matter was argued for some time, it is agreed that the Petitioner will institute a revision petition before the District Court at Ponda to challenge the impugned judgment and order dated 24/11/2021, within a week from today and serve a copy of the revision petition to Respondent No.1 and Mr Redkar who will accept the same on behalf of Respondent No.2. 3.

If the revision petition is indeed instituted within a week from today, the revisional Court is directed to entertain the same on merits, without going into the issue of limitation, if any. 4.

Te above direction is issued as a matter of abundant caution and also because, Respondent No.2 has instituted Civil Revision 31/08/23

3-WP-10-22.DOC Application No.8/2022 against the same judgment and order dated 24/11/2021 before the District Court at Ponda. 5.

Further, it is pointed out that Civil Revision Application No. 8/2022 is scheduled for final hearing on 12/9/2023 at 10.00 a.m. Terefore, it will be appropriate if the Petitioner's revision petition, if instituted within a week from today, is taken up for consideration by the learned District Judge on the same date i.e. 12/9/2023 for final disposal. It is appropriate that both these revision petitions against the same judgment and order are considered and disposed of together by the learned District Judge, finally. 6.

Te learned District Judge is requested to dispose of both the revision petitions as expeditiously as possible and preferably within two months from today.

All contentions of all parties are explicitly left open for consideration by the learned District Judge in these two revision petitions.

Te Petition is disposed of based upon the above agreed order. 9.

Tere shall be no order for costs.
