Heard Shri K. Poulekar, learned Advocate for the applicant who submitted that the quantity of 0.7grams of ecstasy tablet was allegedly recovered at her instance. Nonetheless, it was his contention that there was no compliance with the predicates of Section 50 of the NDPS Act.

Shri S.R. Rivankar, learned Public Prosecutor conceded that the quantity found with the applicant was a variable quantity and appropriate orders could be passed in the matter and which aspect is also verified from the Panchanama placed on record. 3.

In these circumstances, therefore and without going into the merits of the case, the applicant is ordered to be enlarged on the following terms and conditions :

1. The applicant shall be enlarged on bail on executing bail bonds in the amount of ₹50,000/- (Rupees Fifty Thousand only) and furnishing one local surety in coextensive amount to the satisfaction of the learned Additional Sessions Judge,Mapusa.

2. She shall co-operate with the course of investigation and shall not tamper with the witnesses or otherwise intimidate the witnesses in any manner whatsoever.

3. She shall report at the Police Station for a week w.e.f. 25/01/2020 between 10.00am to 12.00 noon and cooperate with the course of investigation.

4. The applicant to deposit her original passport with the Investigating Officer, if not yet surrendered before the Police.

5. She shall not tamper with the witnesses, intimidate the witnesses or hamper the course of the trial in any manner whatsoever.

6. The applicant shall also not leave the State of Goa and the territorial waters of India without the prior written permission of the learned Additional Sessions Judge, Mapusa.
