Mr. Timble, learned Counsel for the Appellant submits that in this case, though there may not be a leave under Section 170 of the Motor Vehicles Act, 1988, the main ground urged by the Appellant-Insurance Company is that there was a breach of the terms and conditions of the insurance policy, inasmuch as the driver did not hold a valid driving licence and further he was intoxicated while driving.

At the request of Mr. Timble, the matter is now posted for final hearing on 24 th March 2022.
