Mr. G. K. Sardessai, learned Counsel appearing for the Applicant, upon instructions, seeks leave to withdraw the application, with liberty to file an application before the learned Industrial Tribunal for modification of the order.

2. Mr. Ryan Menezes, learned Counsel appearing for the respondents has no objection if the application is dismissed as withdrawn. The application is dismissed as withdrawn with liberty to the applicant to file an application before the learned Industrial Tribunal. In case the application is filed by the applicant, the learned Industrial Tribunal shall examine the same, on its own merits, after

MCA/61/2015 hearing the parties in accordance with law.

3. Mr. Sardessai, learned Counsel appearing for the applicant seeks for interim protection until the applicant moves the learned Industrial Tribunal.

4. In the peculiar facts and circumstances of the case, the applicant is at liberty to deposit the total amount due from January, 2015 in terms of the interim orders passed by this Court, before the learned Industrial Tribunal within two weeks from today. Such amount shall be subject to the orders which may be passed by the learned Tribunal in the application filed by the applicant. Liberty to the respondents to file an application for withdrawal which shall be examined by the learned Tribunal on its own merits. F. M. REIS, J.
