Heard learned counsel for the petitioner, who is appearing on behalf of the petitioner under legal aid scheme and learned counsel for the respondent no.3.

2. On behalf of the respondent no.3, affidavit-in-reply has been filed and it is taken on record. It is seen from the affidavit that the contenmor has tendered unconditional apology and has also given his explanation for the delay occurred in complying with the order of this Court. From this explanation it appears that the delay was not intentional. Therefore, apology tendered by respondent no.3, the contemnor is accepted. There being no case made out for proceeding further in the matter, the inquiry is closed and the petition is disposed

CP/1/2016 of accordingly.

3. It is made clear that the averments made by respondent no.3 in paragraphs no.14, 15 and 16 of the Affidavit-in-reply dated 4/2/2016, shall not come in the way of the petitioner, as and when the petitioner files an appeal against the order. All contentions of the petitioner in the case are kept open.
